These Terms of Use apply to your use of CrewCommute.
CrewCommute is operated by Icebreaker Communications. By creating an account or using CrewCommute, you agree to these terms.
If you do not agree, please do not use CrewCommute.
1. What CrewCommute does
CrewCommute is a workplace ride coordination tool.
It helps people from the same organisation identify colleagues travelling a similar way, so they can offer or request rides and share commuting costs fairly.
CrewCommute is not a taxi, rideshare, chauffeur, transport, booking or passenger service. It does not provide transport and does not employ, engage or supervise drivers.
Rides arranged through CrewCommute are private arrangements between users.
2. Voluntary participation
Using CrewCommute is voluntary.
Users may choose whether to:
- create a profile
- save commute details
- post a ride
- request a lift
- accept or decline a ride request
- travel with another user
Drivers are not required to accept ride requests. Riders are not required to request or take any ride.
3. Who can use CrewCommute
CrewCommute is intended for staff or authorised users of participating organisations.
You must use accurate information when creating your profile and arranging rides.
You must not allow someone else to use your account.
You must not use CrewCommute to arrange rides for people who are not authorised users of the relevant organisation.
4. Drivers
Drivers who offer rides through CrewCommute are private individuals sharing their personal vehicle.
Drivers are not employees, contractors, agents or representatives of CrewCommute.
If you offer rides, you are responsible for ensuring that:
- you hold a valid driver licence
- your vehicle is registered, roadworthy and legally allowed to be driven
- you drive safely and comply with road laws
- your vehicle has appropriate insurance
- your insurance allows private cost-sharing or carpooling arrangements
- you only carry passengers within your vehicle's legal seating and safety limits
- you do not drive while impaired, fatigued, distracted or otherwise unsafe
CrewCommute does not verify driver licences, vehicle roadworthiness, registration status or insurance coverage.
5. Riders
If you request or take a ride, you are responsible for deciding whether the ride is suitable for you.
You should use your own judgement when deciding whether to accept a lift, including considering:
- the pickup and drop-off location
- timing
- comfort and safety
- whether you know or are comfortable travelling with the driver
- any workplace or personal requirements that may apply
You may decline or cancel a ride request where the app allows, or choose not to travel with someone again.
6. Ride arrangements
A ride is not confirmed until a rider requests a lift and the driver accepts.
A match, saved commute, possible opportunity or search result does not guarantee that a ride will happen.
Users are responsible for:
- being on time
- communicating relevant pickup details
- cancelling where necessary
- behaving respectfully
- complying with workplace policies where relevant
- making safe decisions before and during travel
CrewCommute may send ride-related messages or status updates, but users remain responsible for coordinating the practical details of each ride.
7. Cost contributions and PayID
CrewCommute suggests a fair contribution towards a ride's running costs.
The suggested contribution is not a fare, commercial charge or profit-making payment. It is intended to help riders and drivers share commuting costs fairly and avoid awkward negotiation about what is reasonable.
CrewCommute's calculation uses the ATO cents-per-kilometre rate as a benchmark for vehicle running costs, but the final suggested contribution may also consider factors such as the shared part of the trip, detour distance, number of seats or riders, rounding and minimum contribution settings. The ATO cents-per-kilometre rate is reviewed regularly by the ATO.
Payment is handled directly between the rider and driver on an honour system.
CrewCommute does not:
- process payments
- hold funds
- confirm that payment has been made
- chase unpaid contributions
- resolve payment disputes
- guarantee that a driver will be paid
- guarantee that a rider will receive a ride after payment
Drivers may provide a PayID so riders can pay them directly. PayID can be a mobile number or email address linked to the driver's bank account, which means the driver does not need to share BSB or account number details.
Users may agree on another payment method between themselves.
8. No commercial driving
CrewCommute is intended for private workplace carpooling and cost sharing.
Drivers must not use CrewCommute to operate a commercial passenger service, taxi service, rideshare business or transport business.
Drivers must not seek to profit from rides arranged through CrewCommute.
If a user appears to be using CrewCommute for commercial driving or inappropriate purposes, CrewCommute may suspend or deactivate their account.
9. Insurance and tax
Users are responsible for their own insurance, tax and legal obligations.
Drivers should check whether their insurer permits private carpooling or cost-sharing arrangements.
Users should seek their own advice if they are unsure about insurance, tax, employment or legal implications.
CrewCommute does not provide insurance, tax or legal advice.
10. Safety and conduct
Users must use CrewCommute respectfully and lawfully.
You must not:
- harass, threaten, bully, intimidate or discriminate against another user
- use CrewCommute for inappropriate personal contact
- misuse another user's personal information
- share another user's pickup location, contact details or ride details without permission
- provide false or misleading information
- post unsafe, unlawful or inappropriate ride offers
- use CrewCommute while impaired or unsafe to drive
- attempt to bypass workplace, safety or platform rules
- use CrewCommute for spam, scams, solicitation or commercial driving
Misuse of the platform may result in account suspension or deactivation.
Where appropriate, CrewCommute may also notify the relevant organisation contact or take other steps to protect users or the service.
11. Privacy
CrewCommute collects and uses personal information as described in the CrewCommute Privacy Policy.
By using CrewCommute, you agree that your information may be used to provide the service, coordinate rides, send ride-related messages, show possible matches, support safety features and provide appropriate organisation-level reporting.
You must not misuse personal information you receive through CrewCommute.
12. Organisation involvement
CrewCommute may be made available through a participating organisation, employer or workplace.
The organisation may help invite staff, manage the pilot and receive reporting about registration, uptake, ride activity or broad commute patterns.
Unless otherwise stated, the organisation is not responsible for rides privately arranged between users.
13. Account suspension or deactivation
CrewCommute may suspend or deactivate an account if we reasonably believe a user has:
- breached these terms
- misused the platform
- provided false or misleading information
- behaved unsafely or inappropriately
- used CrewCommute for commercial driving
- created privacy, safety, legal or operational risks
- stopped being eligible to use the relevant organisation's CrewCommute setup
Users may also request account removal by contacting CrewCommute.
14. Availability and changes
CrewCommute is provided as a pilot/MVP service and may change over time.
We may update, suspend, limit or discontinue parts of the service, including features, organisations, reporting, notifications or matching logic.
We will try to keep the service available, but we do not guarantee uninterrupted, error-free or always-available access.
15. Disclaimers
To the extent permitted by law, CrewCommute does not guarantee:
- that a match will be available
- that a ride request will be accepted
- that a ride will occur
- that users will behave in a particular way
- that a driver, rider, vehicle or route is safe or suitable
- that payment will be made
- that the suggested contribution will suit every circumstance
- that estimated travel, pickup, detour, cost or emissions information will be perfectly accurate
Users are responsible for their own decisions when arranging or taking rides.
16. Liability
To the extent permitted by law, CrewCommute and Icebreaker Communications are not liable for loss, damage, injury, delay, dispute, non-payment, missed appointments, cancellation, accident or incident arising from or connected with a ride arranged through CrewCommute.
This includes incidents occurring before, during or after a journey, including at pickup or drop-off locations.
Nothing in these terms excludes, restricts or modifies any right or guarantee that cannot be excluded under applicable law.
17. Australian Consumer Law
Nothing in these terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law or other applicable law.
Where liability can be limited, our liability is limited to the maximum extent permitted by law.
18. Changes to these terms
We may update these Terms of Use from time to time.
The latest version will be available on the CrewCommute website or platform.
Continued use of CrewCommute after an update means you accept the updated terms.
